A Round Table discussion on new laws and pending legislation in California that have major implications on Pet Owner’s Lives.

Primary discussion will focus on: California S.B 917.

Why discuss these? Read this….

Effective January 1, 2012

Per S.B. 917

“…it shall be a crime, punishable as specified, for any person to willfully sell

or give away as part of a commercial transaction, a live animal on any street,

highway, public right-of-way, parking lot, carnival, or boardwalk, or to

display or offer for sale, or display or offer to give away as part of a

commercial transaction, a live animal if the act of selling or giving away

the live animal is to occur on any street, highway, public right-of-way,

parking lot, carnival, or boardwalk….”

This is now legally considered “animal abuse” and applies to

“any mammal, bird, reptile, amphibian…”

And

“…is punishable as a felony by

imprisonment in the state prison, or by a fine of not more than twenty

thousand dollars ($20,000), or by both that fine and imprisonment, or

alternatively, as a misdemeanor by imprisonment in a county jail for not

more than one year, or by a fine of not more than twenty thousand dollars.

or by both that fine and imprisonment.”

Any person convicted of this animal “abuse” will also be liable for all costs associated with confiscating all of their animals, animal care, etc., and will be banned from owning any animal for 5 years.

There are a few exemptions to this, but the loopholes are huge.

American Kennel clubs are exempt, however, it is against Kennel club policies to sell animals at their events.

Also, the language in this law is vague enough to wonder if online sites such as “Craig’s List” are now considered a “public place.”

What of schools carnivals that offer goldfish as prizes?

If we give or sell one of our pets and do the hand-over in a parking lot?

This is not pending legislation…it was signed by Governor Jerry Brown last summer and went into effect January 1, 2012.

Pending legislation: Senate Bill 969

Would require all pet groomers to be licensed by the state.

“We need basic safety for our pets,” said Sen. Juan Vargas, D-San Diego, who is carrying what he calls “Lucy’s Law.”

His Senate Bill 969 has run into opposition from some San Diego groomers, who favor standards but question the measure’s reach.

Among their concerns: putting the California Veterinary Medical Board in charge, being forced to cage animals that are generally calmer when they are not confined and sending the fees to the state instead of keeping revenues for local needs.

Pet owners are left wondering what the price tag will be to get toe nail trims or shampoos for Polly and Fido. And, are we free to make ANY of our own choices regarding our pets? Could there not be a certification program rather than a license?

Would this criminalize school children who work at the school’s “Dog Wash” fundraiser?

If I trim my own bird’s nails…am I now breaking the law?

PETA-SeaWorld lawsuit goes to court

SAN DIEGO (CNS) - Attorneys for the People for the Ethical Treatment of Animals are scheduled to argue in federal court Monday (Feb 6, 2012) against SeaWorld San Diego on behalf of some of the theme park's killer whales.

PETA filed a lawsuit against SeaWorld last October, demanding that five orcas be released immediately on grounds that the 13th Amendment banning slavery should apply to animals.
